Bruce Lehrmann ordered to pay millions to Network Ten

Bruce Lehrmann has been ordered to pay a whopping $2 million to Network Ten to cover the network's legal fees from his failed defamation lawsuit.

Lehrmann's suit against the network, and in turn The Project and Lisa Wilkinson, came to a end when Justice Michael Lee found he had, on the balance of probabilities, raped Brittany Higgins at Parliament House in March 2019.

The former Liberal staffer's case was dismissed after Justice Lee concluded he was not defamed by Lisa Wilkinson's tell-all interview with Brittany Higgins on The Project in 2021.

Following the conclusion of the case, Lehrmann was ordered to pay Network Ten's astonishing legal fees, returning to court on Thursday to discuss the manner in which they will be paid.

Ten’s barrister Zoe Graus on Thursday told the court that the broadcaster had sought a $2m lump-sum payment from Mr Lehrmann which Justice Lee ordered that Lehrmann pay, though he noted Mr Lehrmann was a man of “modest means”.

As a result, Mr Lehrmann could be forced into bankruptcy if he fails to meet the hefty costs order.

The court was told that Network 10 had offered to pay Ms Wilkinson $607,850 for the journalist’s legal costs, given the fact that she had independent representation during the trial.

However, an independent referee will determine the final amount to be paid to Wilkinson.

Worried your address, birth date or health data is being sold? You should be – and the law isn’t protecting you

Katharine Kemp, UNSW Sydney

Australians don’t know and can’t control how data brokers are spreading their personal information. This is the core finding of a newly released report from the Australian Competition and Consumer Commission (ACCC).

Consumers wanting to rent a property, get an insurance quote or shop online are not given real choices about whether their personal data is shared for other purposes. This exposes Australians to scams, fraud, manipulation and discrimination.

In fact, many don’t even know what kind of data has been collected about them and shared or sold by data firms and other third parties.

Our privacy laws are due for reform. But Australia’s privacy commissioner should also enforce an existing rule: with very limited exceptions, businesses must not collect information about you from third parties.

What are data brokers?

Data brokers generally make their profits by collecting information about individuals from various sources and sharing this personal data with their many business clients. This can include detailed profiles of a person’s family, health, finances and movements.

Data brokers often have no connection with the individual – you may not even recognise the name of a firm that holds vast amounts of information on you. Some of these data brokers are large multinational companies with billions of dollars in revenue.

Consumer and privacy advocates provided the ACCC with evidence of highly concerning data broker practices. One woman tried to find out how data brokers had got hold of her information after receiving targeted medical advertising.

Although she never discovered how they obtained her data, she found out it included her name, date of birth and contact details. It also included inferences about her, such as her retiree status, having no children, not having “high affluence” and being likely to donate to a charity.

ACCC found another data broker was reportedly creating lists of individuals who may be experiencing vulnerability. The categories included:

children, teenage girls and teenage boys

“financially unsavvy” people

elderly people living alone

new migrants

religious minorities

unemployed people

people in financial distress

new migrants

people experiencing pain or who have visited certain medical facilities.

These are all potential vulnerabilities that could be exploited, for example, by scammers or unscrupulous advertisers.

How do they get this information?

The ACCC notes 74% of Australians are uncomfortable with their personal information being shared or sold.

Nonetheless, data brokers sell and share Australian consumers’ personal information every day. Businesses we deal with – for example, when we buy a car or search for natural remedies on an online marketplace – both buy data about us from data brokers and provide them with more.

The ACCC acknowledges consumers haven’t been given a choice about this.

Attempting to read every privacy term is near impossible. The ACCC referred to a recent study which found it would take consumers over 46 hours a month to read every privacy policy they encounter.

The approximate length and time it would take to read an average privacy policy in Australia per month. ACCC Digital Platform Services Inquiry interim report

Even if you could read every term, you still wouldn’t get a clear picture. Businesses use vague wording and data descriptions which confuse consumers and have no fixed meaning. These include “pseudonymised information”, “hashed email addresses”, “aggregated information” and “advertising ID”.

Privacy terms are also presented on a “take it or leave it” basis, even for transactions like applying for a rental property or buying insurance.

The ACCC pointed out 41% of Australians feel they have been pressured to use “rent tech” platforms. These platforms collect an increasing range of information with questionable connection to renting.

A first for Australian consumers

This is the first time an Australian regulator has made an in-depth report on the consumer data practices of data brokers, which are generally hidden from consumers. It comes ten years after the United States Federal Trade Commission (FTC) conducted a similar inquiry into data brokers in the US.

The ACCC report examined the data practices of nine data brokers and other “data firms” operating in Australia. (It added the term “data firms” because some companies sharing data about people argue that they are not data brokers.)

A big difference between the Australian and the US reports is that the FTC is both the consumer watchdog and the privacy regulator. As our competition and consumer watchdog, the ACCC is meant to focus on competition and consumer issues.

We also need our privacy regulator, the Office of the Australian Information Commissioner (OAIC), to pay attention to these findings.

There’s a law against that

The ACCC report shows many examples of businesses collecting personal information about us from third parties. For example, you may be a customer of a business that only has your name and email address. But that business can purchase “data enrichment” services from a data broker to find out your age range, income range and family situation.

The current Privacy Act includes a principle that organisations must collect personal information only from the individual (you) unless it is unreasonable or impracticable to do so. “Impracticable” means practically impossible. This is the direct collection rule.

Yet there is no reported case of the privacy commissioner enforcing the direct collection rule against a data broker or its business customers. Nor has the OAIC issued any specific guidance in this respect. It should do both.

Time to update our privacy laws

Our privacy law was drafted in 1988, long before this complex web of digital data practices emerged. Privacy laws in places such as California and the European Union provide much stronger protections.

The government has announced it plans to introduce a privacy law reform bill this August.

The ACCC report reinforces the need for vital amendments, including a direct right of action for individuals and a rule requiring dealings in personal information to be “fair and reasonable”.<!-- Below is The Conversation's page counter tag. “Meant to be”: Twins give birth just 22 minutes apart

Just days after sharing their 33rd birthday, twin sisters Nicole and Renee Baillie have given birth on the same day.

The women, from Queensland’s Sunshine Coast, were shocked when they fell pregnant around the same time, with their due dates just two weeks apart.

“We magically fell pregnant at the same time, which was crazy,” Nicole told 7News.

Nicole was already at the hospital ready to give birth to her baby when Renee went into labour early.

Renee rushed to the hospital just in time to give birth in the hospital foyer, welcoming a baby girl named Ruby.

“I was just about to have a bath when I heard someone had a baby in the corridor,” Nicole said.

“I couldn’t believe it,” Renee said.

“When I got here, into this room after we had (the baby), I wasn’t sure how far along Nicole was. I didn’t want her (Nicole) to know I’d already had my baby, just in case it, like, threw her off.”

Renee soon found out Nicole had given birth to a baby boy, named Zavian, only 22 minutes earlier.

“I thought I had a few days left, but they decided they wanted to be born on the same day,” Renee said.

“It was just meant to be, and I think everyone has just manifested this happening,” Nicole said.

"I was terrified": Law & Order star reveals traumatic past

Warning: This story contains graphic content.

Mariska Hargitay, who plays Olivia Benson, a character that investigate rapists on Law & Order: Special Victims Unit, has revealed that she too is a victim of sexual assault.

The actress opened up about her traumatic past in a powerful essay written for People Magazine, where she revealed that she was raped by “a friend" when she was in her thirties.

"A man raped me in my thirties," she bravely revealed in the essay.

"It wasn’t sexual at all. It was dominance and control. Overpowering control."

The actress revealed that he was a friend who "made a unilateral decision" and recalled the fear she felt when the incident occurred.

"He grabbed me by the arms and held me down. I was terrified," she said.

"I didn’t want it to escalate to violence. I now know it was already sexual violence, but I was afraid he would become physically violent.

"I went into freeze mode, a common trauma response when there is no option to escape. I checked out of my body," she recalled.

Hargitay, who is the daughter of the late actress Jane Mansfield, said that she never thought of herself as a "survivor", and often "minimised" what happened to her when she talked about it with others.

"My husband Peter remembers me saying, “I mean, it wasn’t rape," she wrote.

"Then things started shifting in me, and I began talking about it more in earnest with those closest to me. They were the first ones to call it what it was."

The actress said that she wants other survivors to feel "no shame" about sexual assault and wants "this violence to end."

She added that justice "may look different for each survivor," but for her she wants "an acknowledgment and an apology" after what happened.

"This is a painful part of my story. The experience was horrible. But it doesn’t come close to defining me, in the same way that no other single part of my story defines me," she concluded, adding that she feels for all sexual violence survivors.

"I’m turning 60, and I’m so deeply grateful for where I am. I’m renewed and I’m flooded with compassion for all of us who have suffered. And I’m still proudly in process."

Hargitay started her own foundation, the Joyful Heart Foundation, in 2004 to help survivors of sexual assault.

Image: Getty

Duke and Duchess ordered to shorten their baby's name

In a world where baby names have become battlegrounds for parental creativity, one Spanish duke is learning the hard way that there's such a thing as too much of a good thing.

Meet Fernando Juan Fitz-James Stuart y de Solís, the 17th Duke of Huéscar and heir apparent to the dukedom of Alba. He and his wife, Sofía Palazuelo, recently welcomed their second child into the world, and they didn't hold back when it came to naming her. In fact, they let their imaginations run so wild that they've run into a bit of a royal roadblock.

Their darling daughter was bestowed with a grand total of TWENTY-FIVE NAMES.

Yes, you read that right. It's like they were trying to set a new record for the world's longest moniker.

The poor girl's full name is Sofía Fernanda Dolores Cayetana Teresa Ángela de la Cruz Micaela del Santísimo Sacramento del Perpetuo Socorro de la Santísima Trinidad y de Todos Los Santos.

In English, that translates to "Sofía Fernanda Dolores Cayetana Teresa Ángela de la Cruz Micaela of the Blessed Sacrament of Perpetual Help of the Holy Trinity and All Saints." Young Sofia would almost certainly need perpetual help writing that out on school and official documents were it not for the obstacle now preventing the 'normous name from sticking.

Now, before you start thinking this was just a case of overly enthusiastic parents throwing every possible name they could think of at their child, hold on a moment. There's a method to this naming madness. Each of those 11 names was carefully chosen to honour important family members, including her mother, grandmother, father and great-uncle. The couple also included a nod to religious devotions, just in case little Sofía needed some divine intervention to carry her name around.

However, the Spanish Civil Registry, apparently not a fan of name-related acrobatics, has thrown a royal wrench into the works. According to their rules, a child's name must contain "no more than one compound name and no more than two simple ones".

In other words, they're putting a cap on the number of monikers a person can have, and Sofía's name blew right past that limit like a speeding chariot.

So, the Duke and Duchess find themselves in a bit of a naming pickle. They need to trim their daughter's name down to size, and that's not a task for the faint of heart. After all, it's not every day that you have to decide which family member's name makes the cut and which one gets the royal snip.

In the meantime, young Sofía will no doubt need a papyrus scroll just to keep track of all those names – and if she ever loses her way, she can simply follow the trail of syllables to find her identity again.

This entire baby-naming escapade is reminiscent of the late Duchess of Alba, who for a time held the Guinness World Record for "most titled aristocrat", holding more than 50 titles in her lifetime. She passed away in 2014 at the ripe old age of 88, and while the young Duke of Huéscar may not be aiming for the world record, he's certainly giving it a good-natured run for its money.

Images: Instagram

Legendary Australian singer-songwriter Shane Howard has made headlines by returning his Order of Australia medal, a gesture that speaks volumes about his deep sense of sadness and disappointment following the Voice to Parliament referendum.

Howard, the renowned frontman of the iconic band Goanna, first captured the hearts of music enthusiasts 41 years ago with the anthemic hit "Solid Rock," a song that passionately decried the colonisation and Indigenous dispossession of Australia.

In a heartfelt letter addressed to the Australian Governor-General, Howard openly expresses his profound sorrow in the wake of the rejected referendum vote.

He wrote: "At this point in history, I can't be proud of my nation and feel honour-bound to return my Order of Australia medal."

This poignant decision resonates with the deep-seated desire Howard had when he penned "Solid Rock, Sacred Ground" four decades ago. “When I wrote the song, 'Solid Rock, Sacred Ground', 40 years ago, I wanted us to address the fundamental lie at the heart of our national story," he continued in the letter. "I dreamt of a country respectful of our ancient history and honest about our modern history. I wanted to be proud of my country.”

Howard, whose great-grandfather was famously arrested at the Eureka Stockade, was awarded the Order of Australia Medal in 2016, honouring his significant contributions to the Australian music landscape. However, he now believes that the democratic principles his family fought for generations ago are facing an imminent threat.

In a recent interview with ABC Victorian Mornings, Howard discussed the motivations behind his decision to return his medal. He emphasised that he felt compelled to make his voice heard in a world rife with disinformation and divisive politics. In his own words, "What else can I do, I'm an artist."

Howard went on to share the distressing experiences he faced, noting that he encountered an alarming amount of abuse and racism on social media. "I copped an enormous amount of abuse that was very intimidating and at times, some stuff that was very, very racist through social media.

"I would say it’s the first time we saw the Brexit or Trump style politics at play in the Australian political landscape."

View this post on Instagram

A post shared by Shane Howard (@goannafella)

Howard's heartfelt letter to the Governor-General underscores his respect for the democratic process that led to the referendum's outcome. Ted Lasso star ordered to pay massive child support sum

Jason Sudeikis has been ordered to pay ex Olivia Wilde an enormous sum of child support, as a bitter two-year custody battle draws to a close.

According to new court filings obtained by Page Six, the Ted Lasso star has allegedly agreed to pay his ex $27,500 ($A42,800) per month in child support for their two kids, Otis, 9, and Daisy, 6.

The hefty settlement has been based on Sudeikis' reported 2023 income of $10.5 million ($A16.3 million) and Wilde’s estimated income of $500,000 ($A778,000).

“The parties agree that child support for the minor children in the amount of $27,500 per month is sufficient to maintain the needs of the minor children considering Jason’s station in life … is consistent with each child’s best interest, and application of the guideline would be unjust or inappropriate in this case,” the court papers reportedly state.

The legal proceedings began two years ago, and took a dramatic turn in 2022 when Wilde, who was promoting her new movie Don't Worry Darling at the time, was served legal papers while on stage delivering a speech at CinemaCon.

At the time, a source told Page Six that Wilde was mortified over the brazen act.

“It seemed unthinkable to her, and it took a moment to set in, but as mortifying as it was, she did not want to give a reaction,” the insider explained.

Since then, things have improved for the couple, as they were both seen putting on a united front at Otis' soccer game in LA.

Wilde and Sudeikis started dating in November 2011 and got engaged in January 2013. They welcomed their two kids before separating in November 2020.

Twin sisters give birth on the same day

Identical twins Gillianne Gogas and Nicole Patrikakos have lived their whole lives in synchronicity after being born together 36 years ago.

Now, the women have welcomed their own children into the world on the same day, in the same hospital.

The extraordinary coincidence happened in Melborune’s Epworth Freemasons hospital, with both Nicole and Gillianne welcoming healthy baby boys just hours apart.

Gillianne said they both felt a mix of emotions over their matching maternity experience.

"The timing, you just can't plan something like that. So yeah, disbelief, shock, excitement, all of those emotions," Gillianne told 9News.

Gillianne's son, Alexander, arrived on August 22 at 1:20pm, followed by sister Nicole's baby boy, William, a mere five hours later.

Nicole said the sisters had the same due date, so the duplicate deliveries were no surprise to the identical twin sisters.

"(We were) very close growing up. We have always done everything together so this is just another example of that," she said.

Gillianne said they had nine months of pregnancy to process their "tandem" due date.

"And yet it is still quite unbelievable," she said.

However, the synchronicity didn’t end there, as the babies were both delivered by the same obstetrician, Dr Joseph Sgroi, who said the births were a first for him during his time as a doctor.

"It is not something that is common. It is not commonplace for even sisters to give birth on the same time or on the same day," he said.

The newborns even had the same birth weight, a healthy 3.5 kilograms.

"Oh yes that came as another surprise," Gillianne said.

"Exactly the same," Nicole said.

Dr Sgroi said the babies would biologically be closer to brothers than cousins, with Nicole and Gillianne hoping they would share the same special relationship as their mothers.

"Hopefully they will be as close as we are because it really is a special bond that we have," Nicole said.

Kate Middleton's strict post-birth rule

As Prince George celebrated his 10th birthday, reports have emerged of a strict rule that Kate Middleton had to follow after she brought her first child into the world one decade ago.

The Princess of Wales gave birth to Prince George at St. Mary's Hospital in London on July 22nd 2013, with the news of the future heir of the throne making waves around the world.

When Prince George was born, centuries of royal tradition and protocol meant no one was allowed to know about the royal birth until the late Queen Elizabeth was told first.

This strict rule meant that Kate had to wait to tell her parents, family and friends until it was confirmed that the Queen was aware of Prince George's birth.

According to reports from Marie Claire, those in the delivery room were also sworn to secrecy to keep their lips sealed.

They also reported the Royal protocol in full, which states that the current monarch should be the first call following the birth of a future monarch.

In terms of how Queen Elizabeth found out, it was revealed that Prince William - the now next-in-line to the throne - called his grandmother from a specially encrypted phone to break the good news.

This isn't the only rule involved in the birth of a royal either, with the huge news coming with a strict set of rules.

As well as being the first to learn of the young prince's birth, Queen Elizabeth also had to approve his name due to the fact that he was a direct heir to the throne, and luckily, Prince George Alexander Louis was a hit!

But it wasn't just about the picture; she had a heartfelt message to share with her fans.

She reflected on the rollercoaster ride of the past few years and how challenges have shaped her into the fierce competitor she is today. Life's too short to take for granted, and every moment is a precious blessing. "You're not in labour": Expectant mum sent away from hospital gives birth at home

A young mother from Ballarat, Victoria, had no choice but to give birth in the front bedroom of her home after being turned away from the maternity ward, even though she was experiencing contractions.

Courtnie Apps, accompanied by her best friend Ashlee Meek, arrived at Ballarat Base Hospital on Monday night, enduring immense pain.

Apps described the experience as intense and was promptly taken to the pregnancy assessment area for testing. However, medical staff concluded that her pain was likely due to a kidney infection, rather than labor.

"They said, 'You're not in labour so this pain you're having must be from your kidney infection, which can be quite painful,'" Apps told 9News.

Disappointed and bewildered, Apps was sent home with painkillers and a strong sleeping pill.

"We're like, 'Are we crazy? We're clearly seeing she's in labour,'" Meek stated, reflecting on their frustration.

The pair returned home, and within an hour, Apps gave birth to her daughter, Alaida Hope.

Meek, who has aspirations of becoming a midwife and is a nursing student with six children of her own, assisted in the delivery.

"I had to put my hand on the baby's head to stop her from coming out too fast and doing too much damage, all while trying to dial triple zero with my other hand," Meeks recalled.

"It was just pure luck really that nothing happened and that baby didn't need any help and that mum didn't have a serious haemorrhage."

After the unexpected home birth, the trio was transported back to Ballarat Base Hospital in an ambulance. However, to their dismay, no one from the hospital has offered an apology thus far. Apps emphasised the importance of listening to patients saying that healthcare professionals should pay attention when patients express that something is wrong.

When approached for a statement, a spokesperson for Grampians Health, the organisation overseeing Ballarat Base Hospital, declined to comment on Apps' case.

The spokesperson cited patient privacy as the reason for not disclosing specific details but assured that patient safety is of utmost importance and their commitment to providing excellent care remains unwavering.

Image: 9News
