Virgin Australia passenger denied travel over tiny passport detail

<p>Renee Reader, 30, flew to Melbourne from the Gold Coast on Monday and had her passport checked several times by Virgin Australia staff. </p> <p>It wasn't until she was in the final boarding queue to Bali when staff spotted one tiny detail in her passport. </p> <p>"I got through security and customs. It wasn't until I was actually boarding the flight and I handed over my boarding pass and passport that the staff weren't sure about my passport," she told <em>Yahoo News Australia</em>.</p> <p>Staff then started taking photos of her passport and she was asked to step aside. When asked what the issue was, she was told there was a "yellow stain" on her passport identification page. </p> <p>It wasn't long before she received the "heartbreaking" news, with staff telling her: "You're not going to Bali." </p> <p>Although she tried to plead her case, airline staff stood firm on their decision, and said Renee would need to be escorted out of the airport by security. </p> <p>"I said, 'I don't think that's quite necessary. I'm not a criminal — It's a passport with a watermark on it'," she recalled, but was she was escorted anyways. </p> <p>While the airline paid for Renee's flight back to the Gold Coast, and acknowledged that they should've flagged the passport damage earlier into her journey, she still lost the money for her return flight tickets to Bali which cost around $200.</p> <p>"My message to everyone is to triple-check your passport and make sure that it is in immaculate condition, because they are getting a lot stricter, and I would never want this to happen to anyone else," she said.</p> <p> "I've travelled all over Europe, I've been to Bali with it [the mark] twice... I was in Bali just in July... it was absolutely heartbreaking," she said.</p> <p>A Virgin Australia spokesperson told <em>Yahoo News </em>that staff are required to flag any passport issues to prevent passengers from being refused entry at their intended destination. </p> <p>"When a guest presents for check-in for an international flight, Virgin Australia team members are required to ensure they have the necessary travel documentation and that the documents are in suitable condition," the spokesperson said.</p> <p><em>Image: TikTok/ Yahoo News</em></p>

Doctor defies terminal cancer diagnosis with breakthrough therapy

<p>Dr Tina Willits was told she had just 24 months to live after being diagnosed with breast cancer, but against all odds she is now in remission. </p> <p>The mother-of-five's disease was "everywhere" with three golf-ball sized tumors in her breast and cancerous masses in her ribs, spine, lymph nodes and legs.</p> <p>"When my cancer was detected, it was pretty past a stage four diagnosis and I was too far gone for a mastectomy," she told the <em>Daily M</em><em>ail</em>. </p> <p>She was placed on end-of-care chemotherapy and was told to "enjoy the time you have left". </p> <p>That was nearly three years ago. Now, the 53-year-old US mum is in remission thanks to a breakthrough cancer therapy that uses cold gases and the body's own cells to freeze and fight tumors. </p> <p>"I was devastated, but I was also like no, I was not ok with that diagnosis. I felt I had to do something," she recalled.</p> <p>"I was just really determined that I did not want to live my life with this cancer, even if they could stop it progressing, I didn't want that, I just wanted it gone."</p> <p>Dr Willits' cancer was HER2 positive, which account for about 20 percent of all diagnoses, and she had no family history of the disease.</p> <p>She underwent four rounds of chemotherapy before she sought alternative treatment at the Williams Cancer Institute. </p> <p>The institute sent her a list of supplements to begin taking and advised her to avoid sugar, which some researchers believe can help reduce inflammation and slow down the growth of cancer cells. </p> <p>She then underwent a treatment regimen that is not yet fully approved in the US, with cryoablation as the first step. </p> <p>Cryoablation is the process where doctors insert  a small metal probe through the skin and into the tumor, extremely cold gasses are then released directly into the mass to kill its cells.</p> <p>In the second phase of her treatment, she received immunotherapy, where eight drugs were administered directly into her tumor, which doctors say can prompt the immune system to recognise cancer cells as a threat and trigger an immune response. </p> <p>Dr Willits told the Dailymail that she was shocked when she got the results from her six-week scan after the treatment.</p> <p>"There were none, no tumors. They were just completely gone," she said. </p> <p>"All the metastasis (cancerous growths outside the breast) had completely healed, and the cancer in my lymph nodes was no longer there."</p> <p>After the treatment she had another four rounds of chemotherapy, and still undergoes PET scans every six months. </p> <p>So far the cancer has not been detected in her body since the treatment, and will need to wait for five years of clear results before she can be declared cancer free. </p> <p>Dr Williams, the founder of the institute, developed the treatment regimen over several years, and believes it could offer a better way to treat cancer.</p> <p>He is currently running a trial of the treatment in hard-to-treat prostate cancer patients, although he did not reveal how long the study had been going on for or how many rounds of treatment the patients had received. </p> <p>Since going into remission Dr Willits has travelled to Honduras and Colorado, tried mountain biking and is training for a 5k marathon for breast cancer awareness. </p> <p>"I wouldn't appreciate life like this if I had not gone through the cancer," she said. </p> <p>"No one on their deathbed says I wish I had worked more or got that job, you all say I wish I had spent more time with my parents and kids or gone to that place I had always wanted to." </p> <p><em>Images: DailyMail</em></p>

What to claim for lost, delayed or damaged bags on overseas flights

And what rules apply when you’re flying between different countries – even if you don’t have travel insurance?</p> <p>Airlines (otherwise known as carriers) generally include baggage requirements in their terms and conditions of carriage, which are set out or referred to on your ticket. These are the rules that apply to the journey that you have booked.</p> <p>But for international flights, a carrier’s liability for damage, loss or delay of baggage is governed by a number of overarching international treaties, which many passengers aren’t aware of.</p> <h2>International agreements</h2> <p>The <a href="http://www.jus.uio.no/lm/air.carriage.warsaw.convention.1929/doc.html">Warsaw Convention</a> of 1929 was the first of these treaties, and the latest is the passenger-friendly 1999 <a href="http://www.jus.uio.no/lm/air.carriage.unification.convention.montreal.1999/">Montreal Convention</a>.</p> <p>In order for one of these treaties to apply to a particular journey, the same treaty must be in place at the point of departure and the passenger’s final destination.</p> <p>For many trips, the agreement that will apply will be the Montreal Convention, which has to date <a href="http://www.icao.int/secretariat/legal/List%20of%20Parties/Mtl99_EN.pdf">108 state parties</a>, covering everywhere from Albania and Australia to Zambia. In time, the Montreal Convention is expected to apply to almost all air travel.</p> <p>The Warsaw Convention (as amended by the <a href="http://www.jus.uio.no/lm/air.carriage.warsaw.convention.hague.protocol.1955/doc.html">Hague Protocol</a> and <a href="http://www.jus.uio.no/lm/air.carriage.warsaw.convention.montreal.protocol.4.1975/doc.html">Montreal Protocol No. 4</a>) will generally apply where the Montreal Convention does not. It is less favourable to passengers.</p> <p>All these treaties have similar provisions to deal with baggage claims – but very different limits to what you might get if you need to make a claim.</p> <h2>What the airline is responsible for</h2> <p>A carrier is liable if your checked baggage is lost, delayed or damaged regardless of fault.</p> <p>This is so unless the damage resulted from the inherent defect or quality of the baggage or, in terms of delay, if it proves that it took all reasonable measures to avoid the damage occasioned by that delay.</p> <p>As for unchecked baggage (that is, carry-on baggage), the carrier is only liable if the damage is due to the fault of the carrier or its agents.</p> <p>Unless otherwise specified, reference to “baggage” includes both checked and unchecked baggage.</p> <h2>Calculating baggage compensation</h2> <p>Under the Warsaw Convention (as amended by the <a href="http://www.jus.uio.no/lm/air.carriage.warsaw.convention.hague.protocol.1955/doc.html">Hague Protocol</a> and <a href="http://www.jus.uio.no/lm/air.carriage.warsaw.convention.montreal.protocol.4.1975/doc.html">Montreal Protocol No. 4</a>) and the Montreal Convention, liability limits are expressed in <a href="http://www.imf.org/external/np/exr/facts/sdr.HTM">special drawing rights</a> (SDRs).</p> <p>An SDR is a type of foreign exchange reserve asset created by the International Monetary Fund. Its value is based on an artificial basket of currencies consisting of the US dollar, the euro, the pound and the Japanese yen. The liability limits are reviewed every five years.</p> <p>As of October 16, 2014, the <a href="http://www.imf.org/external/np/fin/data/param_rms_mth.aspx">value of an SDR</a> is about US$1.49, £0.93 or A$1.70. Current SDR values for other currencies are also listed <a href="http://www.imf.org/external/np/fin/data/param_rms_mth.aspx">here</a>.</p> <h2>So what is your baggage worth?</h2> <p>In terms of baggage liability limits, the Warsaw Convention is of relatively little assistance to passengers.</p> <p>If your international travel is subject to Warsaw (for example, if you flew out of the United States on a one way ticket to Guatemala), liability for delayed, damaged or lost baggage is limited to 17 SDRs (about US$25.33, £15.81 or A$28.90) per kilogram per passenger for checked baggage and 332 SDRs (about US$494.68, £308.76 or A$564.40) per passenger for unchecked baggage.</p> <p>In contrast, a carrier is liable to pay far greater damages if the Montreal Convention applies.</p> <p>For any travel covered by Montreal, the carrier’s liability for baggage is limited to 1131 SDRs per passenger (US$1685.19, £1051.83 or A$1922.70), unless otherwise declared.</p> <p>The carrier is not liable for damages caused by delay if the carrier took all reasonable measures, or if it was impossible for it to take such measures.</p> <h2>Time limits on baggage claims</h2> <p>Time limits are imposed on making a claim for delayed, damaged or lost baggage. Any potential claims should be made to a carrier in writing within these specified limits.</p> <p>Article 26 of Warsaw provides that any complaint as to delay of baggage must be made at the latest within 21 days from the date the baggage was placed at the passenger’s disposal.</p> <figure class="align-right zoomable"></figure> <p>Similarly, under Article 31 of Montreal, a complaint must be made within 21 days of a passenger receiving their baggage.</p> <p>With respect to damaged baggage, under Warsaw, any claim must be made “forthwith” after the discovery of the damage and at most seven days from the date of receipt of the baggage. Montreal also gives passengers seven days from receipt of checked bags to report a damage claim.</p> <p>Neither convention imposes a time limit for reporting lost baggage claims. But it is advisable that you make your complaint as soon as possible.</p> <p>Warsaw does not state when baggage is considered “lost”, leaving it up to carriers to make that ruling. Under Montreal, baggage is only considered lost after 21 days or if the carrier admits that they have lost it.</p> <p>If a passenger fails to make a complaint within the specified times, the carrier will not be liable unless there has been fraud on the carrier’s part.</p> <h2>Insurance alternatives</h2> <p>If you are concerned that the contents of your baggage exceed the liability limits outlined above, you can make a special declaration of the value of your baggage prior to check-in and pay any additional fee (if required).</p> <p>In this case, the carrier will be liable to pay a higher amount, unless it is proved that the declared amount is greater than the actual value of your baggage.</p> <p>Alternatively, prior to travelling, check with your insurance company as to whether your travel insurance covers any excess from delayed, damaged or lost baggage.</p> <p>You might also want to <a href="http://www.icao.int/secretariat/legal/List%20of%20Parties/Mtl99_EN.pdf">check this list</a> to see whether the places you’re departing from and finally arriving at are parties to the Montreal Convention. Man decides to end his own life after waiting for at-home care

<p>A terminally ill man has made the heartbreaking decision to end his life after waiting 10-month for end of life care. </p> <p>Cyril Tooze, an 86-year-old from South Australia's Fleurieu Peninsula, was approved for a Level 4 Home Care Package in January. </p> <p>The package - which is the highest available care for individuals with high-level needs under the federal government’s MyAgedCare scheme - would give Mr Tooze up to $59,594 annually for daily assistance with physical, medical and social tasks.</p> <p>But almost one year on from the approval, his funds and support have yet to be delivered.</p> <p>It’s understood his family, who live interstate, contacted the government to enquire about receiving an urgent reassessment, and were told he could be waiting another three to six months.</p> <p>Independent MP Rebekha Sharkie told reporters that his family were also told a reassessment “could delay it even longer”.</p> <p>While waiting for his vital funds, Mr Tooze - who suffers from terminal heart and lung conditions and regularly requires morphine for pain relief - has worsened and has been hospitalised after suffering a fall at home. </p> <p>Tired of waiting for help to arrive, Tooze has started the process of ending his life through South Australia’s voluntary assisted dying scheme.</p> <p>“There is no hope ... I don’t want to live my life laying in a bed waiting for something to happen,” he told <a href="https://7news.com.au/news/terminally-ill-mans-heartbreaking-decision-to-end-his-life-after-10-month-wait-for-home-care-in-australia-c-16471785" target="_blank" rel="noopener">7News</a>.</p> <p>“You can’t live like that, that’s unfair, we don’t deserve that in such a country as Australia.”</p> <p>Following the media coverage of his case, Tooze was contacted by the Aged Care Department, who said the package could temporarily be made available.</p> <p>Sharkie said Tooze’s situation was “shameful”, saying, “What devastates me is that Mr Tooze feels voluntary assisted dying is the only course available to him, and that is because we as a nation have failed him."</p> <p>“I would say, if Mr Tooze had that package in a timely manner, as he should have, he would probably be sitting at home now, making himself a cup of tea.”</p> <p>Anglicare Australia’s <a href="https://www.anglicare.asn.au/2024/09/20/life-on-the-wait-list-report-shows-older-australians-are-going-without-support/" target="_blank" rel="noopener" data-link-type="article-inline">Life on the Wait List report</a> revealed that as of May 2024, 68,109 Australians had been approved for a Home Care Package but were facing wait times of up to 15 months to access it.</p> <p><em>Image credits: 7News</em></p>

Cruise passengers share why you never leave your cabin balcony door open

<p>A couple on a cruise ship have learned the hard way why you should never leave the balcony door in your cruise cabin open and unattended for too long. </p> <p>While on a cruise around the US and docked in the port of Orlando in Florida, the couple took to TikTok to share their "horror" experience of when their cabin filled up with birds. </p> <p>In the video, they opened the door to their room and were swarmed by a flock of birds as they captioned the video, "When you go on a cruise and you come back to a bunch of (bird emoji) everywhere."</p> <p>"Felt like we were living in a horror movie scene. "Super uncomfortable for everyone": Qantas plays R-rated movie for every passenger

<p>Qantas has issued an apology after an R-rated movie was played for every passenger onboard a flight from Sydney to Tokyo. </p> <p>On Saturday, the flight was delayed by an hour due to problems with the in-flight entertainment system, which resulted in cabin crew only being able to play one film on everyone's individual screens. </p> <p>After requests were taken by passengers, the movie <em>Daddio</em> was chosen. </p> <p>The 2023 drama stars Sean Penn and Dakota Johnson as a taxi driver and his passenger as they discuss their relationships, including an affair Johnson’s character had with a married man.</p> <p>One passenger took to Reddit to share their experience of the flight, saying it was "extremely inappropriate", due to scenes of “graphic nudity and a lot of sexting”.</p> <p>“The kind where you could literally read the texts on screen without needing headphones,” the passenger wrote.</p> <p>“It was super uncomfortable for everyone, especially with families and kids on board.”</p> <p>Another passenger said the airline made the switch to <em>Inside Out 2</em> followed by a New Zealand nature show after playing “40 minutes of penis and boobs”.</p> <p>“These poor kids and the parents because y’all should’ve heard the audible gasps across the plane,” the passenger said.</p> <p>Cabin crew members attempted to fix the screens of those who didn't want to watch the R-rated film, but when this didn't work, resorted to switching the movie entirely. </p> <p>“The movie was clearly not suitable to play for the whole flight and we sincerely apologise to customers for this experience,” a Qantas spokesperson stated.</p> <p>“All screens were changed to a family-friendly movie for the rest of the flight, which is our standard practice for the rare cases where individual movie selection isn’t possible."</p> <p>“We are reviewing how the movie was selected.”</p> <p><em>Image credits: Shutterstock</em></p>

Terminally ill 23-year-old's final request

<p>Liam Bulman was working a shift at The Illawarra Hotel in Wollongong last month when he asked to leave early, as he felt unwell. </p> <p>The following week he found himself in "crippling pain" and was rushed to hospital by his friend. After days of intensive testing, the 23-year-old was diagnosed with stage-four High Grade Neuroendocrine Carcinoma — a "rare" cancer that had spread. </p> <p>Now, his family and friends are doing everything they can to raise funds so he can have a "chance to make memories" through ticking off items on his bucket list in this  "scary, sad and unknown" time. </p> <p>"He's smart and kind. He's been raised to work hard and contribute to people's lives, and our community. He's incredible," Liam's colleagues from The Illawarra Hotel wrote on the<a href="https://www.gofundme.com/f/youre-friendly-local-bartender-bulmans-bucket-list" target="_blank" rel="noopener"> GoFundMe</a> page.</p> <p>So far they have raised over $28,000 of their $50,000 goal, with most of the money raised going towards his medical costs, medical trial attendance and palliative care, and any remaining money will help fund his bucket list. </p> <p>His bucket list includes activities like attending the F1 in Melbourne, going for a joyride in a helicopter, learning to surf and taking a family photo session. </p> <p>Liam's mum, Emily Bulman, revealed his cancer is "incurable" and he has since started a bout of chemotherapy in hope it will "buy him more time" as the cancer has spread to his  lymph nodes and lower digestive tract.</p> <p>"This will assist us to aim for longevity, quality of life, a chance to make memories, and receive the care and comfort that suits Liam best," she said on the fundraising page.</p> <p>"Anything we can raise to help take the burden off Liam, we would be incredibly grateful for."</p> <p><em>Images: GoFundMe/Facebook</em></p>

Passengers on cancelled flights to be compensated under new reforms

<p>Plane passengers could soon be entitled to compensation or refunds for delayed or cancelled flights in Australia. </p> <p>The long-awaited Aviation White Paper will be handed down this morning, as part of the federal government's crackdown on the aviation sector. </p> <p>The white paper makes 56 recommendations, including the the establishment of an Aviation Industry Ombudsman Scheme, which will have the authority to make it compulsory for airlines to provide support to passengers and give travellers more rights. </p> <p>The Aviation Industry Ombudsman Scheme will also be able to refer to allegations of misconduct for investigation and enforcement. </p> <p>It will also introduce a new "Charter of Rights" entitling airline customers to refunds for flights that are disrupted, cancelled, or unreasonably delayed. </p> <p>Infrastructure Minister Catherine King said the changes were critical to ensure that passenger had better experiences in the air, and will provide them with a baseline for the services they can expect on flights. </p> <p>"The aviation customer experience has deteriorated post-COVID, with an urgent need to better protect the rights of the travelling public," she said.</p> <p>She added that Australians were often not being dealt with fairly by airlines. </p> <p>"The bottom line is if people don't get the service that they are expecting, then customers deserve to get their money back or they deserve to get an equivalent service," she said. </p> <p>"And that's really not what's been happening when it comes to the consumer space."</p> <p>Under the Aviation Industry Ombuds Scheme, airlines will also have to "show cause" and provide a valid reason why a flight has been delayed or cancelled, and the ombudsperson has the right to request additional information. </p> <p>Airlines will also be required to provide support to people to make alternative travel arrangements. </p> <p>As part of its white paper, the government will also establish new minimum standards for airlines to make their services more accessible to those with disabilities. </p> <p>Legislation to establish the aviation ombuds office will be introduced next year, but the government plans to appoint an interim ombudsperson. </p> <p>The scheme is expected to be fully implemented in 2026. </p> <p><em>Image: Shutterstock</em></p> <p> </p>

"Pure terror" after Jetstar passenger climbs out onto wing

People were so terrified of what could possibly have gone wrong.”</p> <p>Video capture of the incident shows the man standing on the wing before sliding down the emergency slide, only to be met with police as he reached the ground. </p> <p>The AFP said officers arrested a man for “alleged aggressive behaviour and breaching aircraft safety protocols” and charges were likely to be laid.</p> <p>The remaining passengers safely disembarked the aircraft but had to wait about 45 minutes for their luggage, as the emergency slide had blocked the cargo door.</p> <p>Varghese added that Jetstar were "really good" about the luggage delays, and said the cabin crew did a “great job” handling the situation.</p> <p><em>Image credits: 7News</em></p>

Captain of superyacht breaks silence as missing passengers identified

<p>The captain of the ill-fated superyacht that capsized off the coast of Sicily after being struck by a tornado has spoken out, as the six missing passengers have been identified. </p> <p>Of the 22 people who were on board, 15 were rescued with one tragically pulled dead from the water, believed to be the vessel’s chef.</p> <p>Among those still missing are billionaire tech tycoon <a href="https://oversixty.com.au/travel/travel-trouble/billionaire-tech-tycoon-and-daughter-missing-after-tornado-strikes" target="_blank" rel="noopener">Mike Lynch</a>, 59, who organised the special voyage as a celebration, and was accompanied by his wife Angela and their 18-year-old daughter Hannah. </p> <p>Angela was one of the passengers who were rescued, while Mike and Hannah remain missing.</p> <p>Mike Lynch’s long-term friend Jonathan Bloomer and his wife Judy are also among the missing, as well as Lynch's lawyer Chris Morvillo. </p> <p>Mr Morvillo’s wife, the American jewellery designer, Neda Morvillo, is also missing.</p> <p>The captain of the $27 million Bayesian, James Calfield, 51, is one of the many onboard who are recovering in hospital, as he spoke to local news outlet <em>La Repubblica</em>, saying he had no idea the tornado was heading towards the luxury yacht. </p> <p>“We didn’t see it coming,” he said. </p> <p>The captain of a nearby ship that helped rescue passengers in the aftermath of the incident spoke to <em>Reuters</em> about the moment he noticed the superyacht had vanished.</p> <p>“I don’t absolutely know what they did. Passenger sparks debate over travellers sleeping in aisle seats

<p>A heated debate has erupted online after a passenger suggested those sitting in an aisle seat should remain alert and awake for the entire flight, with the only exception being if it's a long-flight of seven hours or more. </p> <p>“A person sitting in an aisle seat on a plane should not be allowed to sleep," they wrote on Reddit. </p> <p>The reason behind it, according to the passenger, is to ensure that middle and window seat passengers can access the toilet, get served by flight attendants, and evacuate quickly in an emergency. </p> <p>“There are some exceptions and those would probably be on any flight longer than seven hours.</p> <p>“But anything shorter than that, you should not be sleeping. What if the middle or window passenger needs the bathroom, or if the flight attendant needs to hand them something – You’ll be in the way.”</p> <p>They added that a snoozing aisle seat passenger could potentially slow down evacuation during an emergency and put everyone at risk. </p> <p>“Now you would be risking people’s lives because you fell asleep,” they wrote.</p> <p>Social media users flocked to the Reddit thread to share their thoughts. </p> <p> “Nah, just poke me and wake me up if you need me to get up or do something," one wrote. </p> <p>“I’m well aware that I’m in the way, believe me. I’m certainly not there because I wanted to be in the aisle seat.”</p> <p>“If you sleep in an aisle seat, you deal with people getting up. If Australia had an aviation ombudsman, passengers could get compensation for cancelled flights

<div class="theconversation-article-body"><em><a href="https://theconversation.com/profiles/justin-wastnage-489752">Justin Wastnage</a>, <a href="https://theconversation.com/institutions/griffith-university-828">Griffith University</a></em></p> <p>The financial difficulties of <a href="https://www.abc.net.au/news/2024-08-02/rex-airlines-staff-notified-of-termination/104172020">Rex Airlines</a>, coming so soon after the bankruptcy of <a href="https://www.abc.net.au/news/2024-06-26/bonza-directors-accused-of-trading-while-insolvent/104022496">Bonza</a>, have brought into sharp focus one of the federal government’s key priorities for aviation: enhancing passenger rights.</p> <p>In each case, passengers were left with tickets for flights that did not fly. In the case of Rex, tickets were honoured by rivals Virgin Australia and Qantas, possibly trying to recapture the small toehold Rex had established in the Brisbane-Sydney-Melbourne golden triangle.</p> <p>The Bonza story was more complex as the fledgling airline, which collapsed in May, had sought to exploit under-serviced routes to smaller leisure-based cities including Maroochydore and Port Macquarie.</p> <p>In many cases, passengers were left out-of-pocket and stranded.</p> <h2>Support for an ombudsman</h2> <p>These failures will have emboldened the federal government’s plans to introduce stronger passenger protections and an airline ombudsman.</p> <p>The release of its <a href="https://www.infrastructure.gov.au/infrastructure-transport-vehicles/aviation/aviation-white-paper">policy white paper</a> is imminent. The paper covers aviation issues including competition between airports and airlines, the sector’s environmental impact and better mechanisms for consultation.</p> <p>After years of opposition, <a href="https://www.travelweekly.com.au/article/qantas-and-virgin-change-tune-on-aviation-ombudsman-ahead-of-white-paper-release/">Qantas and Virgin quietly fell in behind the idea in May</a>, signalling a deal is close to being announced.</p> <p>The ombudsman is designed to protect consumer rights in what is often monopolistic or quasi-monopolistic operating environments. With the exception of residents of southeast Queensland and the western suburbs of Melbourne, <a href="https://www.sciencedirect.com/science/article/abs/pii/S0967070X18302063">most Australians only have one airport from which to fly.</a></p> <p>This, coupled with an effective airline duopoly, can lead to higher prices and poorer service for consumers, the <a href="https://www.accc.gov.au/system/files/Airline%20competition%20in%20Australia%20-%20June%202023%20report.pdf">Australian Consumer and Competition Commission (ACCC)</a> has argued.</p> <p>The ACCC has been calling for better passenger rights for more than a decade. But its calls grew louder after it fined Qantas <a href="https://theconversation.com/qantas-has-finally-settled-its-ghost-flights-lawsuit-for-120-million-whats-next-229368">A$120 million for selling “ghost” flights in May</a>.</p> <p>Passengers did receive refunds, but the process was not easy compared to many overseas jurisdictions where compensation is automatic and based on distance travelled.</p> <p>Australia is rare among developed countries for not having automatic compensation if a flight is cancelled or delayed.</p> <h2>The EU model</h2> <p>The leader in air passenger rights, as in many areas of consumer protection, is the European Union. <a href="https://eur-lex.europa.eu/eli/reg/2004/261/oj">The EU Passenger Rights regulation</a> is 20 years old and now also applies to rail and bus passengers.</p> <p>The regulation favours the passenger and awards compensation <a href="https://www.airhelp.com/en-int/ec-regulation-261-2004/">of up to €600 (almost A$1,000) for delays or cancellations</a>. There are clauses for when a delay is unavoidable, but generally airlines have now built the scheme into their costs of doing business.</p> <p>The scheme is well publicised and in 2022, about <a href="https://schengen.news/8-million-passengers-affected-by-flight-cancellations-airport-strikes-are-eligible-for-compensation-of-up-to-e600/">eight million passengers were eligible for refunds</a>.</p> <p>Air passenger rights in the UK continued in the EU mould after Brexit and were even strengthened.</p> <p>But in a 2023 review into the UK scheme, <a href="https://www.gov.uk/government/consultations/reforming-aviation-consumer-policy-protecting-air-passenger-rights/outcome/response-to-the-aviation-consumer-policy-reform-consultation#chapter-3-compensation-for-delays-and-cancellations">some airlines argued</a> “private insurance was a better option for some passengers”, particularly those with disabilities.</p> <p>The same reasoning led to the removal of Australia’s previous consumer protection scheme for airline passengers, the <a href="https://www.travelmanagers.com.au/peaceofmind/#:%7E:text=The%20Travel%20Compensation%20Fund%20continued,and%20until%2030%20June%202014.">Travel Compensation Fund</a>, which refunded customers when airlines or travel agencies went bankrupt.</p> <p>The scheme was ended under the Abbott government in June 2014, with travellers told instead to take out their own travel insurance.</p> <p>Labor is expected to reintroduce an element of corporate responsibility for airline delays, not least since Brazil, Canada and Türkiye have also followed the EU’s lead.</p> <p>Brazil’s scheme is particularly generous, with up to R7,500 (A$1,950) available to passengers who have to pay for last minute accommodation if their flight is cancelled.</p> <p>Lawmakers there countered claims by airlines that low cost airline passengers could stay in cheaper hotels, by applying the compensation uniformly, regardless of travel class.</p> <h2>Popular with voters</h2> <p>Air passenger rights can be a vote winner, too. Before he withdrew his bid for reelection, US President Joe Biden trumpeted the <a href="https://www.transportation.gov/briefing-room/biden-harris-administration-announces-final-rule-requiring-automatic-refunds-airline">automatic airline compensation scheme</a> the US Department for Transportation will bring in this year.</p> <p>Until now, airline compensation was mandated by the states without coordinated processes meaning some airlines used vouchers, some credits and a few cash to compensate customers.</p> <p>Despite this, about <a href="https://www.transportation.gov/briefing-room/biden-harris-administration-announces-final-rule-requiring-automatic-refunds-airline">US$3 billion (A$4.6 billion)</a> in refunds have been issued to US passengers since 2020, including more than US$600 million to Southwest Airlines passengers alone.</p> <p>This was due to a serious scheduling crisis which forced the low-cost carrier to cancel almost 60% of its flights in the 2022 summer.</p> <p>By contrast, in Australia, air passengers have only had basic protections under <a href="https://consumer.gov.au/australian-consumer-law/legislation">consumer rights law</a> since deregulation in 2002.</p> <p>There is no guarantee of a seat or even flight the consumer purchased. This has led consumer advocates including <a href="https://www.choice.com.au/consumer-advocacy/policy/policy-submissions/2023/november/aviation-green-paper">Choice</a> to support calls for an airline ombudsman and automatic delay and cancellation compensation.<!-- Below is The Conversation's page counter tag. Flight cancelled after crew member loses it at passenger

<p>An Air Canada flight heading from Morocco to Montreal was cancelled on Friday after a flight attendant lost it at a passenger who reportedly requested a blanket. </p> <p>Viral footage of the incident showed a female flight attendant yelling: “You will behave or we will get off!” at a female passenger. </p> <p>“I’ll tell the captain right away. Yes or no?”</p> <p>When a passenger asked the flight attendant to call the captain, she refused and said: “I don’t want no bullying against my crew”.</p> <p>She then stormed up the aisle before she turned around and yelled: “Everyone behave! <p>Just days after Australian couple David Fisk and Lucita Cortez were <a href="https://oversixty.com.au/health/caring/australian-couple-killed-in-the-philippines-identified" target="_blank" rel="noopener">killed</a> in a luxury hotel in the Philippines, the suspected killer has reportedly turned himself in to police. </p> <p>The bodies of 54-year-old David Fisk and his de-facto partner Lucita Barquin Cortez, 55, were found with their hands and feet tied by hotel staff at the Lake Hotel in Tagaytay city, south of Manila, on Wednesday. </p> <p>The body of another woman, Cortez's  30-year-old daughter-in-law Mary who lives in the Philippines, was also found in the room. </p> <p>A week on from their deaths, Tagaytay Police Chief Charles Daven Capagcuan told the Associated Press that police had a breakthrough in the case when a suspect was identified by three hotel staff from CCTV footage. </p> <p>The identification of the suspect eventually led to his home where he decided to surrender, Capagcuan said.</p> <p>On Wednesday, Sunrise reporter Ben Downie shared the new developments.</p> <p>“Philippines police say this morning a man handed himself in over the hotel homicide where the killer carried out an execution-style attack binding his victims, slashing and suffocating them,” Downie said.</p> <p>“Hotel security footage showed the suspect leaving the room, but didn’t capture him entering, leading to the theory the killer had gained access from a window."</p> <p>“This certainly counts as a breakthrough with the surrendered suspect and closure for loved ones.”</p> <p>After hearing the news of the couple's sudden and tragic passing, Fisk's family, based in NSW's Sutherland Shire, issued a statement saying they "pray for answers and the truth in this horrific matter".</p> <p>"The love we have for our Father and Lucita is so dear and this situation is like living a nightmare," the family said.</p> <p><em>Image credits: GoFundMe / Facebook</em></p>

"I want her parents to know": Fellow Qantas passenger reveals final moments of young woman

<p>The passenger who was seated next to the woman who tragically <a href="https://oversixty.com.au/travel/travel-trouble/young-woman-dies-on-qantas-flight" target="_blank" rel="noopener">died</a> after boarding a Qantas flight has broken his silence on her last moments. </p> <p>Ravinder Singh was seated next to Manpreet Kaur, who passed away shortly after boarding a flight from Melbourne to Delhi on June 20th. </p> <p>The 24-year-old student, who had dreams of becoming a chef, was travelling to see her parents in India for the first time in four years, but did not make it to her destination. </p> <p>Now, Ravinder Singh has shared details on her final moments in the hopes it will bring her grieving parents some comfort. </p> <p>“I was sitting next to her on the Qantas flight from Melbourne to Delhi and was actually the last person to talk to her,” Ravinder Singh exclusively told <a href="https://www.news.com.au/travel/travel-updates/incidents/passenger-speaks-after-woman-dies-next-to-him-on-qantas-flight/news-story/24e8396d8eb3a1d35aea4a4291b847ba" target="_blank" rel="noopener"><em>news.com.au</em></a>.</p> <p>“When I boarded the plane, she was already seated in the aisle. I was in the window, so I asked if she could please get up so I could occupy my seat.</p> <p>“I noticed that she began scrolling through photos on her mobile phone and stopped at a photograph of an elderly couple. I asked if they were her parents. She smiled and nodded and kept staring at it.”</p> <p>Mr Singh, who had been in Australia to visit family, said that everything seemed fine and the plane eventually began moving towards the runway, ready for take off.</p> <p>He explained that Ms Kaur had then put her phone down and rested her head on the seat in front, when he realised something was not right.</p> <p>“She was wearing her seatbelt and leaned forward to rest her head on the seat in front. As the plane was preparing for takeoff, I wanted to alert her to sit upright,” he shared.</p> <p>“But the plane jerked and I expected her to wake up. But instead, her head just moved towards me."</p> <p>“I got the attention of a flight attention and told her that this woman does not seem very well. She checked her pulse and after that, the reaction of the cabin crew was very commendable."</p> <p>“They tried their best to revive her. She was then evacuated by medical staff.”</p> <p>The retired army officer said the incident still “haunts him” and he wants her parents to know that she “left the world peacefully”. </p> <p>“The incident has been etched in my memory for life,” he said.</p> <p>“It is very difficult to digest that a young girl with whom you were just interacting with has passed away in front of your eyes."</p> <p>“Her innocent face stills haunts me and I want her parents to know she loved them a lot. She left this world peacefully looking at their photograph."</p> <p>“My heart breaks for her family who would have been looking forward to seeing her after a long time.”</p> <p>It is understood that Ms Kaur had been feeling "unwell" when she arrived at the airport and boarded the plane with no issues, with reports suggesting she died of tuberculosis. </p> <p><em>Image credits: news.com.au</em></p>

<p>Popular New Zealand TV presenter Joanna Paul-Robie has revealed she is dying of cancer. The pioneering presenter, known for her work on TV3, shared the heartbreaking news during an interview with Radio New Zealand on Friday morning.</p> <p>Paul-Robie, who has been a beloved figure in the broadcasting world, made the announcement while accepting the Icon Award for her contributions to the creative industries.</p> <p>“I was so touched because this award means so much to me, coming from Tauranga Moana,” she said. “But more importantly, because I am, unfortunately, dying – I have terminal cancer – and really to have this award before one posthumously gets it is an even better break. I can’t tell you the lightness, the brightness, the feeling of aroha inside me last night.”</p> <p>Reflecting on her career, Paul-Robie recounted her experiences as one of the few Māori individuals on New Zealand's television screens. “The newsroom was really … it was being run by mostly a pair of middle-class, middle-aged white men who had the audacity and the balls to say ‘If it bleeds, it leads’ but these guys you know they had never been in a Māori world,” she remarked.</p> <p>Starting her career at Radio New Zealand, Paul-Robie later became a newsreader for TV3 and played a significant role in establishing Māori Television in 2004, serving as a program and production manager.</p> <p>During a 2011 interview with <em>NZOnScreen</em>, she spoke about the challenges and triumphs of setting up the network. “There’s been a handful of people in the world who have built a television station and taken it to air,” she said. “There are only a handful of people in the world who can do that and even though it nearly broke me in half on the day that we launched, I thought ‘hell we did that’. I think it is difficult for someone like me with an A-type personality to think now you have done your big thing maybe you should take it easy now.”</p> <p>Paul-Robie's courage and dedication have left an indelible mark on New Zealand's broadcasting landscape. "I am the Bicycle Bandit": Terminally-ill ex-cop confesses to 20-year-old mystery

<p>In a startling twist to a 20-year-old mystery, 73-year-old Kym Allen Parsons, a terminally-ill former police officer and firefighter, has admitted to being the notorious "Bicycle Bandit" who terrorised South Australian banks and residents for a decade.</p> <p>Parsons' confession came just days after receiving approval for voluntary assisted dying (VAD) and being provided with a VAD kit by SA Health.</p> <p>Parsons, who has stage 4 cancer and who had previously denied the charges, changed his plea to guilty during a Supreme Court session on Monday, ending years of speculation and investigation. His sudden admission of guilt follows a plea bargain brokered by the Office of the Director of Public Prosecutions and his counsel after the VAD approval was granted.</p> <p>In a tearful apology read to the court, Parsons expressed deep remorse for his actions, acknowledging that his behaviour was both irrational and without excuse.</p> <p>"I have no excuse for my behaviour," he told the court. "My reasoning was illogical and irrational over that time, and over the past 10 years I have tried to rehabilitate, seek help and forgiveness and demonstrate my shame in distressing actions.</p> <p>"I was fearful of confessing my past and destroying their [my wife and family's] love and trust in the person they knew.</p> <p>"I do not expect your forgiveness, and I humbly ask you accept my sincerest apology and deepest remorse."</p> <p>Despite Parsons' request for bail ahead of his sentencing, Justice Sandi McDonald deemed his crimes too severe for continued freedom and ordered his immediate custody. His access to the VAD kit while in custody remains uncertain.</p> <p>The courtroom was filled with Parsons' victims and their supporters, many of whom had worked at the banks he robbed. Some were victimised multiple times. One victim described the lasting impact of being robbed at gunpoint, detailing the immense trauma and the development of an auto-immune disease likely induced by stress. Other victims recounted struggles with PTSD, anxiety, depression, and ongoing trust issues.</p> <p>Parsons had been scheduled for trial in February on charges of armed robbery, attempted armed robbery, and firearms offences, with prosecutors alleging he stole over $250,000 from 11 banks between 2004 and 2014. DNA evidence was cited as a link to the crimes. His guilty plea and impending death are expected to ignite a legal battle over his $2.4 million estate, involving prosecutors, his heirs, and his victims.</p> <p>Previously, Parsons had been granted home detention due to his terminal stage 4 cancer diagnosis, after significant weight loss while in custody.
