Huge win for Ruby Princess passengers

<p>The passengers of the ill-fated Ruby Princess cruise ship voyage in 2020 have won a class action lawsuit against Carnival Cruise Lines, after a judge determined it was negligent for the voyage to commence. </p> <p>More than 2,600 passengers were onboard the vessel when the ship left from Sydney for a 13-night journey around New Zealand, before an outbreak of Covid-19 forced the cruise ship to turn around.</p> <p>Almost 700 people tested positive to the virus and were held onboard, which results in 28 Covid deaths. </p> <p>The lawsuit alleged that Carnival, which chartered the ship, and its owner/operator Princess Cruise Lines, breached duties of care and Australian Consumer Law.</p> <p>On Wednesday, Justice Angus Stewart found that the cruise company was negligent in certain respects with regard to the precautions taken for passenger safety.</p> <p>He also found the company made misleading representations in pre-holiday communications with passengers, including by suggesting it was "reasonably safe" to take the cruise at the beginning of the pandemic. </p> <p>The class action lawsuit began in October 2022 after two long years of preparation, and ran for five weeks.</p> <p>Susan Karpik was the lead applicant in the class action seeking damages arising from a breach of the consumer guarantees and negligence by the cruise company.</p> <p>In a statement issued by Shine Lawyers on Wednesday, Ms Karpik said she was “pleased with the outcome” but that it was only a “partial win”.</p> <p>“It’s of course only a partial win as 28 lives were lost on this cruise,” she said.</p> <p>“There are many individuals and families who will never recover from this loss.”</p> <p>Shine Lawyers Joint Head of Class Actions Vicky Antzoulatos, who ran the case said, “today is a warning for cruise companies to put passengers ahead of profits.</p> <p>“Carnival should now do the right thing and compensate all the passengers rather than prolong the matter through further litigation,” she said. </p> <p><em>Image credits: Getty Images</em></p>

Tourism Australia's new mascot targeted by animal rights activists

<p>Tourism Australia has seen all kinds of ambassadors campaigning to bring travellers to Aussie shores. </p> <p>Names such as Paul Hogan, Lara Bingle and Kylie Minogue have all been the face of Australian tourism, but the latest ambassador aimed at boosting travellers Down Under is the ever-charming, yet computer-generated, Ruby Roo.</p> <p>Ruby Roo is part of Tourism Australia's push to attract people back to Aussie shores as the nation continues to recover from the Covid-19 pandemic. </p> <p>While the CGI mascot has received a mostly positive welcome online, animal rights activist are not happy, calling out the government's "hypocrisy" over their choice in animal to represent Australia.</p> <p>"If Tourism Australia's Brand Ambassador Ruby Roo was real, she would have been shot as part of a Government 'Kangaroo Management Plan' and hung up by her leg on the back of a ute," NSW Animal Justice Party MP Mark Pearson said.</p> <p>Speaking to 2GB's Ben Fordham, Pearson said "if the tourism industry is going to have the icon as our signature to the world, then talk about what are we actually doing to kangaroos".</p> <p>"We can't keep saying, 'Oh my god, we're overrun with kangaroos' because they've been here for millions of years - they're trying to survive," he said.</p> <p>"We don't know how many kangaroos are out there but this is our native, protected animal, we need to be absolutely certain of how many kangaroos are out there (before we kill them).</p> <p>"This animal is loved around the world."</p> <p>The Australian government estimated there are between 40 and 50 million kangaroos across the country, almost double the nation's population of people. </p> <p>Due to their grazing habits, they've been considered a detrimental pest by some farmers and culling, though controversial, does occur across the country, with certain legal circumstances permitting the shooting of the animal. </p> <p>But Pearson insisted we need to "work with these animals" and not against them.</p> <p>"We need to work with these animals, it's not a competition between a cow and a sheep and a kangaroo," he said.</p> <p>"We're talking about killing kangaroos now and we've been killing kangaroos for 250 years.</p> <p>"If the agriculture industry is saying we've still got a problem then the methodology which is just killing and maiming animals is not working."</p> <p>Animals Australia Director of Development Louise Bonomi echoed Pearson's sentiment.</p> <p>"Tourism Australia using a kangaroo as its 'face' of tourism is the equivalent of Japan adopting a whale as its tourism icon or Canada marketing itself using harp seal images," she said.</p> <p><em>Image credits: Tourism Australia</em></p>

Couple who caught coronavirus on Ruby Princess “can’t wait to cruise again”

<div class="post_body_wrapper"> <div class="post_body"> <div class="body_text "> <p>Despite catching coronavirus on the Ruby Princess, a couple say they can’t wait to cruise again.</p> <p>Ursula Steinberner and Leon Sharp both caught the illness while on board, with Steinberner spending 10 days in intensive care thinking they were going to die.</p> <p>The couple explained that they “can’t wait to go on another cruise” to<span> </span>ABC’s<span> </span><a rel="noopener" href="https://www.abc.net.au/news/2020-05-28/couple-caught-coronavirus-on-ruby-princess-but-will-cruise-again/12283368" target="_blank">7:30</a>.</p> <p>"We've already been down and seen them at Helloworld where we booked our last one," Mr Sharp said.</p> <p>"A lot of people said, 'You got rocks in your head. Why?' I said you've never been on a cruise. This was our first cruise and it won't be our last."</p> <p>Ms Steinberner explained that the cruise ship was “beautiful”.</p> <p>"It was something like being in Las Vegas," Mr Sharp added. "It was just like a floating hotel. Magnificent.</p> <p>"Everything on board was just a highlight. The shows, the staff were fantastic, couldn't do enough for you."</p> <p>The pair recalled feeling ill after returning home to Port Augusta, South Australia.</p> <p>"[I] just started to perspire, I was wringing wet. Ursula saw me and she said, 'What's wrong with you?' And I feel that hot I'm burning up.</p> <p>"I've never been so sick in my life."</p> <p>As Ms Steinberner was a kidney transplant recipient, the virus hit her extremely hard.</p> <p>"I did at one stage think this was curtains for me. You only get so many chances," she told 7.30.</p> <p>The pair are not blaming the cruise company for what happened to them.</p> <p>"It was I think a big case of bad luck, and if you live your life worrying about what you're going to get while you're travelling, you're not really living your life, are you?" Ms Steinberner said.</p> <p>"You'll never go anywhere and that's what we want to do. Heartbroken son speaks out after Ruby Princess cruise ship death: “We’re just extremely mad”

<p>The Ruby Princess cruise ship quickly became a coronavirus hotspot with deadly consequences after eleven passengers passed away.</p> <p>Tasmanian man, 81-year-old Leonard Fisher was one of the victims who lost his life to the virus after boarding the cruise ship and his heartbroken son, Greg has spoken up about the horrific ordeal.</p> <p>Speaking to<u><em><span> </span>60 minutes,</em></u><span> </span>Greg said he wished he’d done more to convince his father out of leaving for his trip but his dad convinced him that if there had been anything wrong on the ship, Princess Cruises would have cancelled the cruise.</p> <p>"He said at my age, I'll probably never get a chance to do another trip like this again," Greg told Bartlett.</p> <p>However, as time went on Greg noticed his dad become increasingly more concerned throughout his trip.</p> <p>"He said that he had a gentleman sitting beside him that was coughing and coughing, and coughing, he had his hand over his mouth, and he was quite concerned about that," Greg told <em>60 Minutes</em>.</p> <p>"He did say that if he was aware that how bad this virus was, and if it was on the ship, he would never have got on the ship."</p> <p>Greg told Channel 9 both he and his dad had trusted the cruise line company as "At no stage were the passengers told that there was a possibility of coronavirus on that boat. They were unaware of any sickness that was on that boat, it was just so wrong,"</p> <p>Np passengers were told that in fact, 104 people on board were sick with respiratory infections and 15 had to be swabbed by the doctor onboard due to his fear of suspected COVID-19.</p> <p>Cruise passengers Gary and Kelly Callaghan expressed their frustrations that they were not warned that the disease had made its way on to the ship.</p> <p>"We are extremely mad, sad and cranky that we weren't told that somebody potentially had it on the ship. We're just extremely mad that we weren't told anything," she said.</p> <p>Neither Kelly or Gary were tested upon departure but instead were ushered quickly off the ship and were allowed to return into their communities and back to their homes.</p> <p>It is possible thousands were infected.</p> <p>"We were all expecting to be tested when we got off just to be sure, to be safe, you're letting us out in the public around people and nobody tested us and I really think that was disgraceful," Gary said.</p> <p>NSW Health deemed that the ship was a “low risk setting”, despite being told there were 15 passengers who had been swabbed for coronavirus.</p> <p>2700 passengers were disembarked without being tested.</p> <p>There are 600 cases of coronavirus linking back to the ruby cruise ship and 11 deaths.</p> <p>The Ruby Princess is now the largest single source of COVID-19 deaths in Australia.</p>

COVID-19 warning: Nine cruise ships floating offshore could “flood our system”

<p>Police are urging foreign cruise ships floating off the NSW coast to sail home rather than risk flooding the state’s hospitals with coronavirus patients.</p> <p>NSW Police Commissioner Mick Fuller on Tuesday said there were a total of nine ships either docked in NSW or waiting off the coast.</p> <p>“There are thousands of people, potentially, in cruise ships off our coasts that aren’t members of our state and if we take them in, then that could well flood our system unnecessarily,” Fuller said.</p> <p>“All the hard work we've done could be over. We will continue to allow them to have fuel and food ... but it is time to go to your port of origin.”</p> <p>The call came after the operator of the Ruby Princess cruise ship, which has been linked to hundreds of coronavirus cases, asked the government to allow the company to repatriate its foreign crew “on compassionate and humanitarian grounds”.</p> <p>Carnival Australia said it was “in high-level federal and state discussions with the aim of enabling the repatriation”.</p> <p>“It is not safe for the ship to sail away from Australia while there are crew members on board who are ill,” the company said in a statement.</p> <p>“While illness on board has been reduced due to strong health management, the ship needs to remain within reach of Australia to access healthcare services if an urgent need arises.”</p> <p>The ship has 1,100 crew from 51 countries, <em><a href="https://www.newcastleherald.com.au/story/6704572/humanitarian-call-to-repatriate-ruby-crew/?cs=9397">AAP</a> </em>reported.</p> <p>The Ruby Princess cruise ship has been linked to 10 per cent of Australia’s coronavirus cases, <em><a href="https://www.theguardian.com/australia-news/2020/mar/31/more-than-400-coronavirus-cases-australia-total-ruby-princess-cruise-ship">The Guardian</a> </em>reported. As of Monday, at least 440 passengers across the country had tested positive for COVID-19 after disembarking from the ship, which <a href="https://www.theguardian.com/australia-news/2020/apr/01/morning-mail-stay-at-home-measures-explained-10-of-cases-from-ruby-princess-locked-down-weddings">docked twice in Sydney in March</a>.</p> <p>NSW has banned all cruise ship passengers from disembarking until new policies are in place. The state will continue to let people disembark cruise ships on humanitarian grounds under Fuller’s personal approval, such as the three crew members with severe symptoms who were taken to hospital on Sunday night.</p>

Each passenger was urged to self-isolate for 14 days.</p> <p>At a press conference on Wednesday, Berejiklian said ABF officials and state colleagues had incorrectly advised NSW Health that the Ruby Princess was low risk.</p> <p>The politician went on to say stopping transmission was a joint responsibility.</p> <p>“Every single agency needs to take responsibility for our borders,” she said. “Whether it’s a ship at a port, whether it’s a planeload of people coming in from overseas. She said NSW Health were working hard to limit onward transmission, and that if there had been any “we would have deployed health teams.”</p> <p>“Of course, with hindsight, we would have acted differently, had we known we had a Covid-positive cruise ship.”</p> <p>Chant fiercely defended NSW Health letting passengers fly home overseas, as it was part of an agreed protocol to send them into self-isolation at home.</p> <p>She said authorities are tracing of people sitting in rows around infected passengers was being conducted.</p> <p>Kristina Keneally who is the Labor’s spokeswoman on immigration said the Ruby Princess would be able to be traced back to many COVID-19 cases in Australia.</p> <p>“We have now 133 passengers and counting from the Ruby Princess cruise ship that have tested positive for coronavirus,” she said.</p> <p>“The Ruby Princess cruise ship coronavirus cases account for 10% of the cases in NSW. And, quite tragically, there has already been one death.</p> <p>“They went into taxis and public transport, they interacted with friends and neighbours, they went to shops, they were allowed to travel across the country,” she said.</p> <p>“It is gobsmacking that we are in this circumstance today. We need to ask, we need to demand to know how this happened and we need to ensure it does not happen again. The Australian government needs to get on top of this situation very quickly.” Topics</p> <p>Outram’s timelines of interactions between the ship and NSW Health are as follows:</p> <p>He said that ABF’s responsibilities went as far to checking passports and ensuring that customs regulations were complied with.</p> <p>He said the federal Department of Agriculture was responsible for biosecurity checks.</p> <p>“On the 17 March, 2020, NSW Health requested the following information from the Ruby Princess’s senior doctor: estimates of arrival into Sydney, a log of details of passengers and crew presenting with fever or acute respiratory symptoms or both, travel histories, and whether tests were conducted and the results,” Outram said.</p> <p>“On March 18, at 9.39 am the senior doctor on the Ruby Princess notified the health department with the following: they had collected viral swabs for a few cases of febrile influenza, negative test, and that those people had been isolated. However, in accordance with the Australian government guidance, all passengers must go into self-isolation for 14 days,’” Outram said.</p> <p>The ABF commissioner continued by saying that on the 18th of March, the Department of Agriculture was informed through Ruby Princess that a risk assessment had been conducted.</p> <p>He also went on to say that the ship had been considered “low risk” – an assessment that is consistent with NSW Health’s version of events.</p> <p> “NSW Health decided not to board the vessel and attend, and that they had also given clearance for all passengers to disembark the vessel,” Outram said.</p> <p>“That red light has just gone green. So, the vessel came into port on March 19.</p> <p>“They felt the vessel was low risk and there was no need to attend the vessel, but our six officers wore masks and gloves nonetheless.”</p>
