"I need answers": Devastated widow vows to stage hunger strike

A woman who lost her husband and son in the devastating crash at a pub in Victoria last year has vowed to stage a protest, just days after the driver of the car was dismissed of all charges.

In November 2023, 66-year-old William Swale was behind the wheel of his BMW when he suffered a medical episode, crashing into the beer garden of The Royal Daylesford Hotel, killing five people.

Charges against Mr Swale were dropped on Thursday, after a magistrate ruled the evidence against him was “so weak”.

Mr Swale's lawyers successfully argued his actions were not voluntary because he was in a state of severe hypoglycaemia, as he is an insulin-dependent diabetic.

After hearing that the charges were dropped, Ruchi Bhatia, whose husband Vivek, their son Vihaan, 11, were killed as a result of the crash, says the ruling is as though she has lost them all over again.

Ruchi and her nine-year-old son were also injured in the crash, but survived after spending months in hospital.

Speaking for the first time since the deadly incident, Bhatia expressed her pain and said it feels like her life has been torn apart again, recalling the horrifying moment she woke in hospital to learn her husband and eldest son did not make it.

“Still today I don’t believe that they are not with me,” she told 7News.

“We were just having fun, we were outside, we were all together and the next moment they were gone and I’m never going to see them again.”

In court on Thursday, Magistrate Guillaume Bailin found the prosecution case was flawed and decided not to commit Swale to stand criminal trial, as all charges were dropped and Mr Swale walked out of court a free man.

Despite the ruling, Bhatia is demanding answers and says her fight for justice is far from over.

“He stopped the car in the middle of the road — why did he start his engine again? I need answers for that,” she said.

Bhatia and her family are planning to protest, which will include a hunger strike.

While Bhatia said she knew the protest wouldn't bring back her family, she said they needed justice to move on from the tragedy.

Charges dropped over crash that killed five people

The elderly driver who was charged after his car crashed into a pub in Victoria, resulting in the deaths of two children and three adults, will walk free after charges against him were dropped.

William Herbert Swale, 66, had all charges dismissed after a magistrate ruled the evidence against him was “so weak”.

Mr Swale's lawyers successfully argued his actions were not voluntary because he was in a state of severe hypoglycaemia, as he is an insulin-dependent diabetic.

The devastating crash occurred on November 5th 2023, when Mr Swale's car sped down a hill before crashing into an outdoor dining area outside The Royal Daylesford Hotel.

Pratibha Sharma, her husband Jatin Chugh, and her daughter Anvi were enjoying the last of the weekend at the pub when Mr Swale's BMW crashed through the pub.

Sharma and Chugh died at the scene, while nine-year-old Anvi was flown to hospital but did not survive her injuries and was later pronounced dead.

The family were joined by their friends, Vivek Bhatia, 38, his wife, and their two kids at the pub.

Vivek and his 11-year-old son Vihaan were both killed in the crash, while the 36-year-old woman, and a second son, aged six, were taken to hospital for their injuries and survived.

Initially rushed to hospital after the crash, Mr Swale was charged with 14 offences following a month-long police investigation.

Prosecutors alleged that as a type-1 diabetic of 30 years, Mr Swale should've known not to be driving while in a state of hypoglycaemia, alleging gross negligence.

After a three-day hearing, Magistrate Guillaume Bailin determined the evidence against Mr Swale was so flawed it should not be sent to a higher court for a jury trial, and instead dismissed all charges.

“It is reasonably possible the accused was suffering a severe hypoglycemic event; the result of which means his actions in driving from 5.36pm onwards were not voluntary,” Magistrate Bailin said. “The evidence is so weak that the prospects of convictions are minimal."

Image credits: ABC News / Magistrates' Court of Victoria

Restaurant charges diners $95 to slice up birthday cake

A restaurant in Italy has been slammed online after charging a group of diners a hefty cost to simply cut a birthday cake into slices.

A family attended the high-end restaurant in the southern area of Arezzo to celebrate their mother's birthday, after they had asked the restaurant in advance if they could bring in an outside cake.

After enjoying their meal, which came to a whopping €659 or $1,083 AUD, they were slapped with another fee of €58 or $95 to cut the cake and bring it to the table.

Local news outlet Corriere Fiorentino reported that the cost of slicing the cake was more than the cake itself.

Two of the dinner guests shared the story of the expensive fee on a local Facebook page, claiming the restaurant said it is the rule of their establishment and they were required to pay it.

The owner of the restaurant told the Italian media site, "We do not charge a cover charge and we mainly serve dishes of our own production, so we try to discourage those who bring things from outside."

"If we consider that in Arezzo the average cover charge is 2.5 euros per person, there is not such a big difference," they said as they explained the group of diners was 13 people.

"My restaurant has to pay for the waiter who serves at the table, the dishwasher and other related services. We have to recover them somehow."

However, the owner did admit, "I wasn't there that evening and my employees were perhaps too fussy in managing the situation that had arisen, perhaps cutting the usual price a little or even not charging anything for the cake."

"Better 50 euros less and people going home happy than this misunderstanding in which we are all damaged."

Image credits: Corriere Fiorentino / Shutterstock

Couple charges guests to attend their wedding

A couple have made the divisive decision to charge their loved ones to attend their wedding in order to save money.

When newlyweds Nova and Reemo Styles, a couple from the US, they were originally quoted $150,000 USD ($227,936 AUD) for their dream nuptials.

"That's the number they were starting at," Nova explained to US news outlet ABC 7.

In order to cut down on costs without cutting out any extravagant extras from their big day, the couple decided to put a price on attendance, and slap their loved ones with a fee.

"And I said, 'People choose to go to Beyoncé's concert, because they know that they're gonna have an experience’. Let's put the stress on the guests, and let's sell tickets for a wedding,'" Nova admitted.

Her new husband Reemo admitted he wasn’t too keen on the idea, as he recalled telling his wife “Babe, people aren’t going to come.”

The couple decided to charge guests $333 USD ($510 AUD) each, which earned them a place on a double-decker bus for the reception which took them on a 12-hour adventure in New York City.

The controversial move ended up saving the couple $70,000 USD ($106,260 AUD), and their big day went off without a hitch.

They admitted that they received pushback from some guests, as NOva recalled one invitee saying, "I would never spend money on tickets. I don't care. Who do you guys think you are? Jay-Z and Beyoncé?”

The couple stood by their choice to charge their guests, as many friends and family did fork out the hefty fee.

Nova and Reemo’s story quickly made it to the ‘wedding shaming’ Reddit group, where social media users were not so sympathetic and were quick to condemn their “tacky” and “ridiculous” choice.

"Talk about TACKY! I would never think of making someone pay to come to my wedding! That is just ridiculous...," one said.

"I absolutely would not pay to come to a wedding, because I'm already paying to go -- gas, time to get ready, a gift, that's money/time I could spend in other ways," another said.

"That's probably the dumbest thing I've ever heard. I would imagine many guests RSVP no," added another.

Another user was quick to point out that if they needed help covering such a huge sum of money, they should’ve chosen to cut back on the extravagant day instead of expecting their loved ones to cover the cost.

This attack occurred just days after the alleged gang rape of a 25-year-old Australian woman in the French capital, highlighting escalating security risks as the Games approach.

Channel Nine’s Director of Sport, Brent Williams (pictured above), informed staff that the two technicians had left the International Broadcast Centre and were walking to their accommodation in the north-eastern suburb of Le Bourget when they were assaulted by a group of men.

Describing the incident as "an assault of a serious physical nature", Williams confirmed that the victims managed to escape and find safety. The incident has been reported to the police.

In light of this attack, Nine has reminded its staff to stay vigilant and to remove their Olympic credentials when not required, especially when travelling. Broadcasters have been warned by security experts that despite increased military and police presence in the capital, criminals may still target those they perceive as vulnerable.

This incident follows another harrowing event involving an Australian citizen. The Paris prosecutor's office has confirmed an investigation into the alleged gang rape of a 25-year-old Australian woman, which occurred on the night of July 19 to 20. The woman sought refuge in a café in the 18th arrondissement. French Interior Minister Gérald Darmanin has stated that while the investigation is a matter for the police, he is closely monitoring developments.

Darmanin has also issued a handwritten letter to all police officers, gendarmes, firefighters, emergency service personnel and intelligence agents, acknowledging the difficulty of their task.

“The eyes of the world will be fixed on you," Darmanin wrote. "Your task will not be easy", urging them after four years of intense presentation to “present the most beautiful face of France”.

The French authorities have deployed 35,000 police and gendarmes, with plans to increase this number to 45,000 for the opening ceremony. Additionally, 18,000 soldiers are on standby to counter potential threats, with an Islamist terror attack being the primary concern for organisers.

As preparations continue, authorities are under immense pressure to safeguard the Games and mitigate the risks posed by criminal activities and potential terrorist threats. The world will be watching as Paris strives to balance the celebration of athletic achievement with the paramount need for security.

Image: Richard Ellis/UPI/Shutterstock Editorial
